1. About these Terms
These Terms and Conditions (“Terms”) govern access to and use of the Human Rights Careers Academy website, paid membership, courses, activities, downloads, certificates and related services (together, the “Academy”). By creating an account, placing an order or using the Academy, you agree to these Terms.
Please read the Terms before purchasing. The Privacy Policy and the 14-Day Refund and Withdrawal Policy also apply. If you do not agree, do not create a paid membership or use the Academy.
2. Service provider
The Academy is operated by:
Human Rights Careers e.U.
Mag. Robert Markus Fellner
Breitenfeldergasse 6-8/1/23
1080 Vienna, Austria
Company number: FN 534686 d
VAT number: ATU75556337
Email: admin@humanrightscareers.com
3. Eligibility
You must be at least 18 years old and legally capable of entering into a contract to purchase a membership. A person under 18 may use the Academy only with the involvement and permission of a parent or legal guardian who agrees to be responsible for the account and payment.
If you purchase on behalf of an organisation, you confirm that you have authority to bind that organisation. Mandatory consumer protections apply only where the purchaser qualifies as a consumer under applicable law.
4. Academy membership and service
A paid membership provides access to the courses and features included in the plan shown at checkout for as long as the membership remains active. Features may include self-paced courses, interactive activities, saved progress, private workbook or toolkit entries, downloads, printable materials, community activities and certificates.
Membership is a right to access the Academy during the paid period. It does not transfer ownership of any course or provide perpetual access after the membership ends, unless a specific item is expressly described as a permanent download.
Course descriptions, included content, plan duration, billing interval, price and applicable taxes are displayed before purchase. The order confirmation sent to you records the contract. Access normally begins after successful payment.
5. Your account
You must provide accurate, current information and keep it updated. Your account is personal to you unless an organisational or multi-user plan expressly permits additional users. You may not share login credentials, sell account access or allow another person to use your account as their own.
You are responsible for keeping your password secure and for activity carried out through your account. Notify us promptly at admin@humanrightscareers.com if you suspect unauthorised access. We may require reasonable identity verification before changing account details or responding to a security request.
6. Prices, taxes and payment
The price, currency, billing interval and any applicable tax are shown during checkout. The final checkout amount is the amount due for the first billing period. You authorise us and our payment processor to charge the selected payment method for the initial payment and each renewal until the membership is cancelled.
Payments are processed by Stripe and may also be subject to Stripe’s terms and privacy notice. We do not store complete payment-card details. If a payment fails, we may retry it, ask you to update the payment method, limit access, or end the membership after reasonable notice.
You are responsible for ensuring that billing information is correct. If you need an invoice with particular details, provide them during checkout or contact us promptly.
7. Automatic renewal
Unless the checkout clearly states otherwise, memberships renew automatically for the same billing interval shown when you purchased. The renewal charge is normally taken at the beginning of each new billing period using the saved payment method. Renewal continues until you cancel.
We may change the price of a future renewal. If we do, we will give reasonable advance notice and the new price will apply only from a later renewal date. You may cancel before the new price takes effect. We will not retroactively increase a price already paid for a current billing period.
8. Cancellation
You may cancel at any time through your Academy account, where the cancellation control is available, or by emailing admin@humanrightscareers.com. To avoid a renewal, submit the cancellation before the next renewal charge. If an account cancellation control is unavailable or does not work, an email sent before the renewal date is sufficient evidence of a timely cancellation.
Cancellation stops future renewal and normally becomes effective at the end of the current paid billing period. You can continue using the Academy until that date. Cancellation does not automatically delete your account or saved course entries; see the Privacy Policy for data retention and deletion requests.
9. Refunds and withdrawal
Our 14-Day Refund and Withdrawal Policy forms part of these Terms. In summary, you may request a full refund of the initial payment for a membership purchased directly from us within 14 calendar days after the contract is concluded, even if you have started using the Academy. The policy applies to the initial payment and does not automatically restart for each renewal.
After the initial 14-day period, payments are normally non-refundable and we do not provide a proportional refund for unused time, except where required by law or expressly stated in the Refund and Withdrawal Policy.
10. Course entries and other content you provide
You retain ownership of the original answers, reflections, plans, application materials and other content you enter into the Academy (“Learner Content”). You give us a limited, non-exclusive, worldwide, royalty-free licence to host, copy, process, display back to you, format, export, print, secure and otherwise use Learner Content only as needed to operate and support the Academy and comply with law. This licence ends when the content is deleted from our active systems, subject to temporary backups and legal retention requirements.
Private documentation and workbook entries are private to your account and are not intentionally displayed to other learners. Some clearly labelled community activities may display a contribution to other participants or in an aggregate visual. By submitting to such an activity, you permit us to display the contribution in the manner described at the point of submission.
You are responsible for Learner Content. Do not submit content that is unlawful, defamatory, discriminatory, threatening, infringing, deceptive, malicious, or that violates another person’s privacy or intellectual-property rights. Do not enter confidential case information or identifiable personal data about clients, rights-holders, survivors, colleagues or other third parties. Use anonymised or fictional examples where possible.
We may remove Learner Content where reasonably necessary to comply with law, protect a person, maintain security, enforce these Terms or respond to a valid complaint. Where appropriate, we will give notice and an opportunity to clarify or correct the issue.
11. Academy content and intellectual property
The Academy, including course text, videos, graphics, illustrations, activity designs, templates, downloadable resources, assessments, certificates, branding, software and compilation of materials, is owned by or licensed to Human Rights Careers e.U. and is protected by copyright and other intellectual-property laws.
While your membership is active, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access Academy content for your own learning and professional development. You may download or print materials only where the Academy provides that function, and you may use a completed workbook containing your own entries for your personal career development.
Unless we give written permission, you may not reproduce or republish a course, share paid downloads, distribute templates as standalone products, record or scrape the Academy, create a competing course from Academy materials, remove rights notices, bypass access controls, or use Academy content to train a machine-learning model.
12. Acceptable use
You must not:
use the Academy for unlawful, fraudulent, abusive or harmful activity;
attempt to gain unauthorised access to another account, the website, database or server;
introduce malware, overload the service, conduct automated scraping, or interfere with security or normal operation;
impersonate another person or misrepresent your affiliation;
harass another learner or submit hateful, discriminatory or threatening content; or
use community or support features to send spam, advertisements or unsolicited promotions.
13. Educational purpose and certificates
Academy content is provided for education and professional development. It is not legal advice, immigration advice, financial advice, psychological counselling or a substitute for advice from an appropriately qualified professional. Examples, templates and exercises must be adapted to your own circumstances.
A course certificate confirms completion of the Academy requirements stated for that course. Unless expressly stated otherwise, it is not an academic degree, regulated professional qualification or guarantee that an employer, university, government body or professional association will recognise it.
We do not guarantee employment, interviews, admission, promotion, income, career results or any specific outcome from using the Academy. Your results depend on many factors outside our control.
14. Community and shared activities
Where the Academy offers a shared activity or community feature, participate respectfully and assume that anything you deliberately post there may be seen by other participants. Do not post sensitive or confidential information. We may establish additional community guidelines and moderate content to maintain a safe, inclusive and lawful learning environment.
15. Third-party links and resources
Courses may link to external websites, organisations, job advertisements, resources or tools for reference. We do not control third-party services and are not responsible for their availability, content, security or privacy practices. A link does not necessarily mean endorsement. Review the third party’s terms and privacy information before using its service or providing personal data.
16. Availability and changes to the Academy
We aim to keep the Academy available and useful, but uninterrupted or error-free access cannot be guaranteed. Temporary interruptions may occur for maintenance, security, updates, internet failures or events outside our reasonable control.
We may update course content, activities, instructors, layouts and technical features to improve quality, accuracy, accessibility or security. We may also add or remove courses. During an active paid period, we will not intentionally remove the core value of the membership without a reasonable alternative, notice, refund or other remedy where required by law.
17. Suspension and termination
We may temporarily restrict or suspend access where reasonably necessary to protect the Academy, investigate suspected misuse, address a failed payment, comply with law or prevent harm. We may terminate an account for a serious or repeated breach of these Terms. Where the situation can be corrected, we will normally provide notice and a reasonable opportunity to do so.
If we terminate without fault on your part before the end of a paid period and do not provide substantially equivalent access, we will provide a proportionate refund for the unused period unless another remedy is required by law. No refund is due for a termination caused by your serious breach, except where mandatory law provides otherwise.
18. Privacy
Our Privacy Policy explains what personal data we process, why we process it, how saved course entries are handled, which service providers receive data, how long data is retained and how to exercise your rights. The Privacy Policy forms part of the information provided with these Terms but is not a contractual waiver of your statutory data-protection rights.
19. Liability and mandatory rights
Nothing in these Terms excludes or limits liability where it cannot legally be excluded or limited, including liability for intentional conduct, gross negligence, personal injury, or rights and remedies that mandatory consumer law gives you.
For consumers, the applicable statutory rules on warranty, conformity of digital services, damages and remedies remain in force. Any disclaimer in these Terms applies only to the extent permitted by those rules.
To the extent permitted by law, we are not responsible for a result based on a learner’s independent decision, an inaccurate or outdated third-party source, or a third-party website or service outside our control. You remain responsible for reviewing and adapting course materials before using them in an application, workplace, legal process or other real-world context.
20. Changes to these Terms
We may update these Terms to reflect changes in law, security, technology or the Academy. The updated version will be published with a new “last updated” date. Changes will not retroactively alter a payment or completed billing period.
If a material change adversely affects an active membership, we will provide reasonable advance notice. You may cancel before the change takes effect. Where the law requires express agreement to a change, we will request it.
21. Governing law and disputes
These Terms and the contract are governed by Austrian law, excluding its conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protection provided by the law of the country where you habitually reside.
Courts have jurisdiction according to the mandatory rules that apply. Nothing in these Terms restricts a consumer’s right to bring a claim before a court that has jurisdiction under applicable consumer law.
We are not willing or obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless applicable law requires otherwise. Please contact admin@humanrightscareers.com first so that we can try to resolve a concern directly.
22. Severability and no waiver
If a provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will be treated in the manner required by applicable law. A delay in enforcing a right does not waive that right.
